GUIDELINES FOR TV SATELLITE DISC INSTALLATIONS

1. Section 4.04 of the Association’s CC&Rs as written prohibit installation of
any kind of exterior device for the reception of radio, television or other
means of communication. However, this rule has now been superseded in part by a
congressional mandate, the Telecommunications Act of 1996 and implementing
regulations of the Federal Communications Commission. The following guidelines
set out what the Association can and cannot allow under these new regulations
and are by no means intended to encourage these installations, as they are
considered inimical to the clean and attractive environment we want to maintain
in our community.
2. Although architectural approval may not now be required for certain
conforming devices, the Committee still must be consulted in advance of any
contemplated installation. It is expected that primary attention will be
directed to placing the disc out of view from the street, court or public area.
Rear decks or patios should be investigated first.
3. The installation must be confined to areas within the lot and under the
control of the owner. This generally means balconies and patios or decks,
because roofs are under the control of the Association. Accordingly, the owner
will be responsible for repairing any roof damage by an installer and for any
leaks resulting therefrom. Since the owner is already responsible for
maintaining exterior walls, any damage to walls or consequent leaks from an
installation will also be his responsibility.
4. A satellite disc must not exceed 39 inches in diameter and should be painted
to match surroundings (warranty permitting) and also screened or camouflaged
where costs would not be excessive.
5. These guidelines apply only to expanded (non-local) television reception. The
Association’s current CC&Rs prohibition of antennas or discs for all other means
of communication remain in effect as before.
